Brian D. O’Reilly, is a partner and trial attorney focusing his practice on intellectual
property matters and complex business disputes. As a result of his litigation expertise,
Brian is also adept in counseling clients in how to predict and avoid possible litigation.
While Brian represents clients in all facets of IP, he has extensive experience
in patent litigation, representing clients from diverse fields - from pharmaceutical
companies throughout some of their largest and crucial patent litigations to tech
companies on strategically important patent litigations. He is also experienced
in representing companies asserting and defending trademark rights. In addition,
Brian’s copyright litigation victories have broken new legal ground. Brian’s innovative
and strategic approach to complex business disputes has made him an aggressive,
accomplished and successful advocate for his clients.
Counseling clients with respect to creating, evaluating and managing their IP portfolios
and strategies, and those of competitors, goes hand and hand with Brian’s litigation
practice. Brian is recognized for his ability to predict outcomes of complex patent
litigation enabling his clients to make lucrative business and financial decisions.
Because of both his technical and legal expertise, Brian’s clients rely on him to
assist in the development and design of key products to avoid patent infringement
and litigation risks, and assess and avoid the possibility of future conflicts with
others’ rights. Brian efficiently and effectively designs patent strategies that
protect his clients’ long term business interests and goals.
Brian’s background is in chemistry and he is a registered patent attorney. He graduated
at the top of his class from New York University School of Law (Magna Cum Laude).
Prior to joining Epstein Drangel LLP, Brian clerked for the Honorable Kent A. Jordan
in Federal District Court and practiced at the top litigation firm in the country
(Cravath Swaine & Moore). This experience and his dedication to his practice is

Brian is a member of the Bar of the District of Massachusetts, the Southern and
Eastern District of New York, and is registered to practice before the United States
Patent and Trademark Office.
